This Privacy Policy describes how awareyess (“we,” “us” or “our”) collects, uses, and shares information about you and the choices you have regarding this information. This Privacy Policy applies to the information we collect when you access or use our products, services, and technology platforms (including our mobile application that help us provide the coaching services) (collectively, the “Services”). Please note that this Privacy Policy does not apply to your use of third-party sites, services, or applications you may access through our Services. We encourage you to review the privacy policies of those third parties for more information regarding their privacy practices.

Collection of Information

If you visit our website or use our mobile application we will collect certain information about you.

 

Information You Provide to Us

We collect information you provide directly to us when interacting with us or using the Services. The specific information we collect depends on the context of your interactions with awareyess, as detailed below.

 

Platform Members 

To create an account we use your name, your company name and company email address. We don’t use your email address within the mobile application. We will also collect information as it relates to your use of the platform. For example, we collect information when you download our mobile application(s) and the versions used.

 

Through your use of the Services, you will also provide us information to facilitate your coaching experience. For example, you will be asked to complete several surveys that will allow you to gain insight into your values, personal characteristics and happiness. To facilitate a robust and meaningful coaching experience, both you and your coach will have access to your survey responses. Your company will not have access to your personal survey responses. We will provide reports to your company where we de-identify the data and provide summary information.

 

We may also collect information such as your coaching platform usage, insight module assignments planned and completed, engagement status, session ratings, and any other information you choose to provide in conjunction with the Services. You may be asked to provide your opinions on the quality of coaching sessions. These opinions or reviews will be shared with the coach, on a de-identified basis, for quality purposes.

Use of Information

We may use the information we collect to provide, maintain, and improve the Services, including to assess and improve the quality of the Services and to personalize suggestions.

Sharing of Information

When you use the Services, we will share information about you with your coaches so that they can provide services to you, such as responses to surveys, responses to insight modules and journal entries.

 

We will share limited information with the employer or other entity who has sponsored your coaching program, such as how you used the Services (such as the number of completed assignments). We will not share with your employer your survey responses or personal information you share with our platform or with your coach. Information we do share with your employer, or other entity who has sponsored your use, is provided in an aggregated and de-identified form. 

 

We may also share or transfer information about you as follows or as otherwise described in this Privacy Policy:

 

  • With vendors, consultants, and other service providers who need access to such information to carry out work on our behalf and on a need-to-know basis;
  • In response to a request for information if we believe disclosure is in accordance with any applicable law, regulation, or legal process, or as otherwise required by any applicable law, rule, or regulation;
  • If we believe your actions are inconsistent with the spirit or language of our user agreements or policies, or to protect the rights, property, and safety of you, us, or others;
  • In connection with, or during negotiations of, any merger, sale of our assets, financing, or acquisition of all or a portion of our business to another company; and
  • With your consent or at your direction, including if we notify you through the Services that certain information you provide will be shared in a particular manner and you provide this information.

Data Storage

We are based in the Netherlands and the information we collect is governed by Dutch law. Your data is stored in Europe. 

Data Retention

We store the info we collected about you for as long as is necessary for the purpose(s) for which we originally collected it, or for other legitimate business purposes, including to meet our legal, regulatory, or other compliance obligations.

Your Information

You may update, correct or delete information about you at any time by contacting us at info@awareyess.com. Please note that we may retain certain information as required by law or for legitimate business purposes. We may also retain cached or archived copies of information about you for a certain period.

European Economic Area

If you are in the European Economic Area (“EEA”), you have certain rights and protections under the law regarding the processing of your personal data.

 

Legal Basis for Processing

If you are in the EEA, when we process your personal data we will only do so in the following situations:

 

  • We need to use your personal data to perform our responsibilities under our contract with your employer or coach
  • We have a legitimate interest in processing your personal data. For example, we process your personal data in order to provide you the Services, to communicate with you about changes to our Services, and to provide, secure, and improve our Services; or
  • You have provided consent for us to process your personal data.

 

Data Subject Requests

If you are in the EEA, you have the right to access personal data we hold about you and to ask that your personal data be corrected, erased, or transferred.  You may also have the right to object to, or request that we restrict, certain processing. Questions or Complaints

If you are in the EEA and have a concern about our processing of personal data that we are not able to resolve, you have the right to lodge a complaint with the data privacy authority where you reside.
